Terms and Conditions of Sale
Please take a few moments to read these Terms and Conditions carefully. By using or purchasing from our website, you agree to the following terms and conditions.
1. Definitions
1.1 Agreement: A contract between OOSI Living and the customer for the sale and purchase of goods or services, subject to these terms and conditions.
1.2 Goods: The products agreed to be supplied by OOSI Living to the customer.
1.3 Services: Any services agreed to be performed by OOSI Living for the customer.
1.4 Quotation: A form or document provided by OOSI Living detailing the goods or services offered.
1.5 Sales Order: A document confirming the customer's order of goods or services.
1.6 Sales Invoice: The invoice issued by OOSI Living to the customer for the goods or services supplied.
2. General Terms
2.1 These terms apply to all purchases made on the OOSI Living website (www.oosi.living).
2.2 By placing an order, you accept these terms and conditions.
2.3 Any special conditions specified in a Quotation, Sales Order, or Sales Invoice will take precedence over these terms to the extent of any inconsistency.
2.4 No other terms and conditions will apply to the Agreement, including any you purport to make when placing an order with us.
2.5 An Agreement may only be canceled or varied with our prior written consent.
3. Quotations and Orders
3.1 A Quotation is valid for 30 days unless otherwise stated and is an invitation to treat, not an obligation to sell.
3.2 No contractual relationship arises from a Quotation until your order has been accepted by us in writing, and after you have made full payment of the deposit where required.
3.3 Every Quotation, Sales Order, or Sales Invoice is subject to obtaining any necessary import, export, or other licenses. If we cannot obtain such a license, we reserve the right to cancel the order without liability, except to return any deposit paid.
4. Pricing and Payment
4.1 All prices are in Australian Dollars (AUD) and include GST unless otherwise noted.
4.2 Prices exclude delivery, installation, insurance in transit, packaging, and handling charges unless specified.
4.3 Payment terms will be specified in the Quotation or Sales Order. For non-account holders, full payment is required before delivery. Account holders must pay invoices within the agreed terms.
4.4 We accept payment by Visa, MasterCard, and American Express. Surcharges may apply to credit card payments.
4.5 Time for payment is of the essence. Failure to pay on time may result in suspension of delivery, cancellation of the Agreement, and/or interest charges on the outstanding amount.
5. Delivery
5.1 Delivery times are estimates and not guaranteed. We are not liable for delays beyond our control.
5.2 Delivery is deemed complete when goods are delivered to the specified address.
5.3 We reserve the right to make part deliveries, each constituting a separate sale.
5.4 If you are unable to accept delivery at the agreed time, we may charge storage fees and invoice you for the goods.
5.5 It is your responsibility to ensure delivery details are accurate. We are not liable for failed deliveries due to incorrect information or absence.
6. Returns and Refunds
6.1 Our returns and refunds policy complies with Australian Consumer Law.
6.2 You are entitled to a refund or replacement for major faults or defects in the product.
6.3 For change of mind returns, requests must comply with our Change of Mind policy. Products must be unused, in their original packaging, and in resellable condition. A restocking fee may apply.
6.4 Refunds for approved returns will exclude delivery costs.
6.5 To initiate a return or refund, contact our team. Proof of purchase and photographic evidence may be required.
7. Warranty
7.1 OOSI Living products come with a manufacturer’s warranty, details of which are provided on each product page.
7.2 Warranty claims must be submitted according to our warranty claim process. Supporting documentation, such as photos and proof of purchase will be required.
7.3 Warranty does not cover misuse, negligence, or damage caused by improper assembly.
8. Limitation of Liability
8.1 To the extent permitted by law, OOSI Living’s liability is limited to the replacement of products, supply of equivalent goods, or a refund.
8.2 We are not responsible for any indirect, incidental, or consequential damages resulting from your purchase.
9. Intellectual Property
9.1 All content, including logos, images, and text, on the OOSI Living website is protected by copyright and intellectual property laws.
9.2 You may not use, reproduce, or distribute our content without prior written consent.
10. Governing Law
10.1 These terms and conditions are governed by the laws of Australia.
10.2 Any disputes will be resolved under the exclusive jurisdiction of Australian courts.
